Pursuant to a series of agreements and <br />conveyances, Anschutz granted easements over certain portions <br />of the Ranch to Snowmass Coal Company (^Snowmass^) for road <br />and conveyor rights-of-way, a truck dump site, and a unit- <br />train coal loading facility (the ^Easements^). Minrec, Inc. <br />(^Minrec^), the successor-in-interest to Snowmass, now holds <br />all of Snowmass' rights under the Easements. The lands <br />covered by the Easements are subject to the captioned permit <br />(the ^Snowmass Permit^). <br />Anschutz has agreed to sell the Ranch to Aspen Glen <br />Golf Partners (^Aspen Glen^). Aspen Glen desires to develop <br />the Ranch as a golf course with related residential and retail <br />uses. Aspen Glen is concerned by the Easements and would like <br />Minrec to release the Easements prior to the scheduled closing <br />of the sale of the Ranch on December 30, 1991. <br />Jim Stover of Minrec told me that Minrec would <br />release the Easements if Minrec received a full and final <br />release of its performance bond and reclamation obligations <br />under the Snowmass Permit with respect to the lands covered by <br />the Easements. <br />As we discussed last week, I would appreciate it if <br />you would prepare a letter from the Mined Land Reclamation <br />Division addressed to Minrec, Anschutz and Aspen Glen that <br />
