12/14/04 TUE 11:57 FAb 15124ba7711 TDW
Colorado and Glen Stinson as defendants to its causes of action against the
Barkers in the hope that the addition of the State of Colorado would, in the
words of $TU Empire's counsel, "...destroy diversity under 28 U.S.C. §
1332 and ...require remand of this case to state district court pursuant to 28
U.S.C. § 1447(e)." Certainly, the "Justice" standard articulated by Fed. R. Civ.
P. 15(a) does not support the amendment of BTU Empire's original complaint
to add additional defendants in this situation.
Respectfully submitted this 14`x' day of December, 2004.
F'OGNANI GUIBORD & SOMSY, LLP
- ~rl..
John D.
