Cattany <br />Division Director <br /> Natural Resource Trustee <br />RE: Adequacy Review Permit # M=1983-176 AM #2 <br />Dear Mr. Laired <br />The Division has reviewed you Amendment application that propose to add 8 acres to the <br />existing permit for a total of 75.5 acres and has the following adequacy comments. <br />n GENERAL <br />The Amended area was inspected on December 3, 2003 and was found to be as described <br />in the permit amendment application. The post mining Land use will be the same as was <br />approved in the previolis Amendment application, which is lined water storage area. <br />Urban Flood Drainage control was notified and appeared to have given their approval. <br />II) EXHIBITS "A" THRU "F" ADEQUATE <br />III) EXHIBIT "G" WATER INFORMATION <br />A) The operator proposes to replace two ground water monitoring wells that <br />are presently located in the Amended area, that will be mined out, with <br />one well. Given the hydraulic, gradient for the area, the one replacement <br />well is acceptable. It is also the understanding of the Division that Asphalt <br />Specialties agreed to replace any well with in 600 hundred Feet of the <br />proposed amended area, that could be impacted by the operation. <br />IV) EXHIBTT "H' WILDLIFE INFORMATION <br />A) You have received comments from DOW and apparently have addressed <br />their issues. <br />V) EXHIBITS "I THRU "K' ADEQUATE <br />VI) EXHIBIT "L" RECLAMATION COST <br />A) The operator proposes to reduce the shorelines for the reservoir by 110 <br />linear feet. No additional warranty will be required for the amended area. <br />The warranty will remain AT $678,169. <br />VII) EXHIBITS "M THRU "S" ADEQAUTE <br />Office of Office of Colorado <br />Mined Land Reclamation Active and Inactive Mines Geological Survey <br />
