.. _ r <br />permit boundary, whether internal access roads, or pre-law affected lands, ill not be <br />considered as operating outside of the permit boundary, or as mining witho t u permit. <br />The consideration is for purposes of accounting in the determination of the reclamation <br />liability of the Operator and the Stale for all affected land. <br />Map #4 -Release Areas, provided with this submittal, shows all existing roads d pre-law <br />affected lands and the respective acreages qualifying for release. While all r ads will be <br />released, ten percent of the total area will be calculated in the financi 1 warranty <br />consideration as a reserve against any potential need to reclaim a portion o [he access <br />roads. This is an accounting consideration only. Also, the snap corrects an ov rsight from <br />previous submittals, defining the North and South Boundaries as the H & I li e, with the <br />acreage of both the North and South Quarry pre-existing roads included in the t tal. <br />The total area to be released from the 25.0 acre limitation of maximum affected land at any <br />given point in tune under the financial warranty of the approved conversion permit and <br />subsequent technical revision is 12.5 acres. This leaves a balance of 11.8 acres of <br />Affected Land, liberating 13.92 acres for quarry expansion. As the technical vision will <br />indicate, only 5.71 acres have been identified as targeted for possible expansi n of quarry <br />activities in 1998, no[ including any marginal expansion on existing active qu ry locations <br />not otherwise potlrayed, but which will be measured following [he next aet'ial photograph <br />for next years annual report to the Division. <br />The terms of this request are consistent with the approved terms of t approved <br />conversion permit and subsequent information portrayed under [he 30 Ja uary 1998 <br />Technical Revision. The aerial photographs provided with the Conversion Pe it and the <br />30 January 1998 Technical Revision satisfy the requirements of site measu ements and <br />photography pertinent to this release [Refer [o Map #4 -Release Areas, inclu d with [his <br />submittal]. A copy of the proof of notification to the Owner of the Affected and and to <br />Larimer County Board of County Commissioners. All notifications were sent by certified <br />mail, return receipt, and include a copy of all attachments included with this s brnittal [see <br />enclosures, below]. <br />This should satisfy the statutory requirements for release of the access roads d pre-law <br />affected lands from warranty consideration, as provided under the terms of t e approved <br />conversion permit, and pending your verification by inspection of the prop ty.
