~ • <br />any; any restrictions, reservations, or exceptions contained in <br />any United States or State of Colorado Patents of record; all <br />zoning and other governmental rules and regulations; general <br />property taxes for the current year; and expressly subject to all <br />of the following: <br />Leases and Tenancies: None. <br />Mineral Exceptions or Reservations: Those of record. <br />Mortgages or Deeds of Trust: None. <br />Miscellaneous: Terms, agreements, provisions, conditions, and <br />obligations as contained in Agreement for Purpose of Collecting <br />Field Data between The Northern Colorado Water Conservancy <br />District and Weaver Ranch, Inc. recorded October 15, 1986, under <br />Reception No. 86059780 of the Larimer County, Colorado records. <br />Grant of Easement: In order to provide vehicular access <br />betwe~=_n County Road 72 and the Property, the Grantor herein <br />expressly grants unto the Grantee, its successors and assigns, <br />forever, a non-exclusive perpetual road easement and <br />right-of-way, for ingress and egress, over and across the parcel <br />of real estate which is legally described on Exhibit "B" attached <br />hereto and incorporated herein by reference. The aforesaid <br />easem~ant (hereinafter "the Road Easement") is granted and <br />conveyed by the Grantor to the Grantee subject to the following <br />terms and conditions: <br />L. The Grantee shall have the right to construct, <br />maintain, repair, and improve an access road (hereinafter "the <br />Access Road") within the Road Easement. <br />?_. The Road Easement shall be non-exclusive, thereby <br />allowing the Grantor, its successors, assigns, and invitees, to <br />use the Access Road. <br />3. The Grantee shall be solely responsible to pay for the <br />construction, maintenance, and repair of the Access Road. <br />4.
