The maximum depth of the mine will be 45 feet. <br />2. The size of the excavated area will be between 5 and 10 acres at any given time, and <br />that 5 acres will be devoted to product stockpile, topsoil and related processing <br />equipment. <br />3. There will be no asph2lt or concrete plant, temporary or permanenf, located at the <br />mine site. <br />With the addition of these permit conditions and others the State akeady plans to include <br />(see your letter of August 27, 2004 to me) and pursuant to Regulation 2.7.3(3) of the <br />Minerals Rules and Regulations of the Colorado Mined Land Reclamation Board for the <br />Extraction of Construction Materials, I (and those I am representing) see no need for this <br />matter to be considered by the Colorado Mined Land Reclamation Boazd during its <br />September 22 and 23 meeting. We therefore withdraw as parties to the objection in my <br />letter filed with your office on July 28, 2004. Signed agreements from each party to this <br />objection aze attached. Ptease send me a copy of the permit with the conditions at your <br />earliest convenience. <br />
