_0
Sutrj: Wetland Delineatlans for the Niek Gray properties
Date: 09119P2001 3:58:58 PM Mountain Daylight Time
from: Nll9ezei@spk.usace.anny.mi7(Mezei, NickSPfq
To: mvripp@aolcom ('mvri p@aol.com)
Mike
I reviewed the material you provided, which includes the wetland
delineations on both sites, as well as your cover letter stating chat: "We
stated in our mining plan that we intend to stay out of the wetland areas
and provide silt fencing where appropriate so that adjacent operations will
not discharge material into these areas."
My review also included a phone call to the wetland consultant. Based
on the information provided, it is clear that the wetland areas at Gray 1
Gravel Pit are rtot jurisdictional under the Clean Water Act since they are
all isolated from and not adjat~nt to a jurisdictional stream. The wetland
and spring complex at Gray 2 Gravel Pit is jurisdctional under the Clean
Water Act since it is cl~rly Mbutary to a jurisdictional stream. The
jurisdictional wetland appears to be accurately mapped, with supporting data
sheet documentation.
Since there wilt rxrt be a fill into the jurisdictiatal wetland, and it
will be protected from sediment loading bi+ a siN fence, there would not be
a need for a Deparbmerrt of ttie Army permit. Such permits are ~/ required
if there is ~ unavoidable placement of fill material into a waters of ttre
United States. such as a str~n or vaetland, I ,hope thattttis memo.lespnds
to your concerns.
Nick Mezei
Headers
Return-Path: <NMezsil~spk.usace.amry.mih
Recehred: from riy-yb04.rmr.ad.cxxrt (dy-yb04.mail.ad.cam [172.18.148.4)) by airarb04.mail.ad.corn
(x80.17) with ESMTP kl AAAiLINYB44-0919175958; Wed. 19 Sep?D01 17:59:5&2000
Received: from eagle.spk,tJSaceamy.mii (tat~ama.spk.t~aceanrty:mii [130185.83.14D by dy-
O1rM100 rrix.aoi.com (x8021) vritlr F.SMTR,1d AAAiLRELAYINYB41-0919'17G93T: Wed; 19-Sep 2001 17:59:32 -
Reoeived: from tehama.spkusace.amry.mil by eagiespkusace.army.mR
vla smtpd (fa' yb.mx.ad.com [20b.188.156,122)1 wlih SMTP:19 Sep ZOOt 2200:37 UT
Received: fiom tetunne.spit.usar~.amry.mii by phalaror.spkusraoaarnry.mil
via smipd (for yb.mx.ad.com [205.188:156.12Zj)wlth SMTP; 19 Sep 200121:5$23 L1T
Recehred: from spkmai104.spk.usace.amry.mil (splvraai04.spk.usace.amyrrril [130.165.63.13n
by tehama.spkusaoe.arrrry.mtl (8.9.318.9.3) with ESMTP Id OAA01806
for <mvripp(d~aol.com>: Wed. 19 Sep 2001 14:69:47-0700 (PDT)
Received: by spkrnar704.spk.usace.army.mflwlth Internet Mail Servk~ (5.52653:19)
id <TDMFRPF9>; Wed, 19 Se}~ 2001 14:59:30-0700
Message-ID: <5F61343300F7D4ttA5970002B30A1EF40957E4@aplvnaN07.spk.usace.amty.mil>
From: "Mezei, Nick SPK" <NMezei(r~splr.usace.amry.mil>
To: '"mvripp@ad.gpm'" <rnvripp~aol.com>
Subject Welland Delirrcetlons ~ the Nkdt Gray propertles
Date: Wed, 19 Sep 2001 14:5929 -0700
X-Mailer.
