Since Coherex is listed as a designated chemical in the <br />pending Environmental Protection Plan for the Henderson Mine and Mill, the Coherex station upgrade is subject [o <br />the environmental protection facilities design and construction requirements and the certification and inspection <br />requirements of Rules 7.3 and 7.4 of the Hard Rock/Metal Mining Rules of [he Mined Land Reclamation Board. <br />Based on the design information submitted in your July 20, 1998 letter, the Division hereby issues approval to <br />proceed with the demolition of the existing Coherex station and excavation of contaminated soils. Prior to disposal of <br />excavated soils or backfilling of the excavation, the following information must be provided for review by [he <br />Division: <br />What type of testing will be conducted to determine the limit of the contaminated soils to be excavated? <br />What contaminant concentration criteria will be applied to define the limit of the soil contamination? <br />2. Provide a disposal plan for the Coherex-contaminated soils. <br />Once the preceding issues have been addressed to the Division's satisfaction, the remainder of the project may <br />proceed in accordance with the plan provided. Prior [o filling [he new Coherex tanks, Climax Ivtolybdenum Company <br />must provide a certified verification by a professional engineer or other qualified individual that will confirm that the <br />facility was constructed in accordance with the approved design plan, and the Division must accept this certification <br />in writing. In accordance with Rule 7.4, [he Division may schedule an inspection of the Coherex station excavation <br />depending on [he nature your responses [o item no. I listed above. If such an inspection is scheduled, [he excavation <br />may nat be backfilled until the inspection has been conducted and the Division has issued authorization to proceed <br />(Rule 7.3.
