Eric Bikis Page 2 ~` <br />June 25, 2004 <br />Mr. Scott owns the 2.0 cfs Snow Ditch, Priority 151, June 10, 1900, water right, <br />which has been used to irrigate 14.6 acres of pasture land adjacent to Angel Lake. The <br />water right has not experienced a call from downstream users. Mr. Scott intends to use <br />a portion of this water right to offset depletions caused by operation of the pit. An <br />analysis performed in this office has determined that the consumptive use credits from <br />the dry-up of 3.0 acres of land under the Snow Ditch water right will offset the depletions <br />caused by Canyon Sand and Gravel during the May 15 -September 15"' call period. <br />The State and Division Engineers have reviewed the plan and the adequacy of <br />each source of water provided for use as augmentation water, including, where <br />necessary, the historical consumptive use of each water right or other fully consumable <br />waters proposed for use as augmentation water. <br />This substitute water supply plan is hereby approved pursuant to Section 37-90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This plan shall be valid through June 25, 2006, unless otherwise revoked or <br />mod~ed. <br />2. Active mining of the site may resume only after approval of the well permit in <br />accordance with §37-90-137(2) and (11), C.R.S. A well permit application was <br />submitted to this office under receipt no. 315278 and that application is <br />pending evaluation. Either consent or a hearing will be required prior to the <br />issuance of the permit if another well is located within 600 feet of the maximum <br />gravel pit pond boundaries. Should a new welt permit be denied for reasons of <br />600 foot spacing, or any other legitimate reason, approval of this substitute <br />supply plan will be canceled. <br />3. The actual allowed water surface exposure may not exceed 4.31 acres. <br />4. The consumption associated with this mining operation is limited to evaporation <br />and water contained in the mined product, which must not exceed 3.4 acre-feet <br />during the plan year and 1.5 acre-feet during the May 15 -September 15 period. <br />5. The amount and location of the dry-up of the irrigated acreage associated with <br />the applicant's shares of the Snow Ditch must be documented and approved <br />by the Water Commissioner before any consumptive use credits are available <br />for use under this plan. A map and legal description of the dry-up must be <br />submitted to the Water Commissioner, Division Engineer and the State <br />Engineer by July 15, 2004. <br />6. Accounting of water in this plan, including excavated area, area of actual <br />ground water exposure, stream depletions, and dry-up area must be provided <br />to the Water Commissioner and Division Engineer on forms and at times <br />acceptable to them. Said accounting must be received by the 10w of the <br />month following the month being reported. The name, mailing address, and <br />phone number of the contact person who is responsible for operation and <br />accounting of this plan must be provided on the accounting forms. <br />
