The Use by Special Review permit is for an open-pit coal mine <br />and ash disposal as submitted in the application materials on <br />file in the Department or' Planning Services and subject to <br />the Development Standards stated herein. <br />'~' The applicant shall dispose of only those materials from <br />~ ~ sources which have been reviewed and approved by the Health <br />Department staff. Laboratory analysis of a sample of ash <br />~frcm each source is required to be submitted for review and <br />approval. <br />3. Fly ash and/or bottom ash shall be transported in a manner <br />that will prevent any fugitive dust from leavincr the <br />transport. vehicle during loading, transport, and off loading. <br />4. The disposal site shall be maintained in such a manner as to <br />prevent any fugitive dust from blowing or drifting off the <br />immediate disposal site at any time. Sufficient water spray <br />and/or cover materials shall be available to be applied in <br />order to abate dust ccnditions at any time necessary. <br />5. The disposal cells shall have a minimum of four feet of soil, <br />regolith, mantlerock, or bedrock material between the top of <br />the groundwater table and the floor of the deposited ash <br />waste pit. The site shall have a minimum of four feet of <br />cover over the ash at final grade. <br />6. The Special Use permit area shall be maintained in such a <br />manner so as to prevent soil erosion, fugitive dust, and <br />growth of noxious weeds. The site shall be maintained in <br />such a manner as to present a neat and well-kept appearance. <br />7. Excavation generated traffic of a commercial nature shall be <br />required to utilize the haul road as shown on the Special Use <br />permit plan. The point of access for the haul road shall he <br />at Weld County Road 5~, south of the Special Use permit area. <br />8. The active mining area shall be fenced with a three-strand <br />barbed wire fence. The fence shall remain until the area is <br />fully reclaimed. <br />870279 <br />
