C-80-005) -Technical Revision 35 <br />Response to Adequacy Review Comments <br />Deaz Mr. Boulay: <br />Enclosed please fmd three copies of revised and/ox additional information for TR-35 addressing the <br />Adequacy Comments in your May 7, 2002 letter with regard to the application for permit renewal <br />RN04 to the Seneca II Mine Permit No. C-80-005. The original comment/issue and the response to <br />each comment aze provided below. <br />Comment 7a. It appears that many of the existing mock pondr do not meet the derign criteria ar rpecifzed in the <br />approvedpermit document. Appendix 13-9 rpecifically mater that all track tanks will be conrtruded aaording to <br />State of Colorado, Offzce of State Engineer's "Specifications to Govern the Conrtruction of a Livertock Water <br />Tank"and USDA Sail Conrervatian Service i rpetificationr far tan.~r. Many of the rtotk ponds do not meet the <br />reguirementr for one or both of there documentr. The Division recommends that SCC revise Appendix 13-9 to <br />remove ref rence to the USDA Sail Conrervation Service i rpecrficatzonr, and to mate that all impoundmenu bath <br />temporary andpermanent will meet the design criteria rpecified in the Regulatianr of the Colorado Mined (I~ndJ <br />Reclamation Board (Rule 4.05.9). All impoundments that are intended to be retained ar permanent portmining <br />features shall comply with appk'cable mate engineer ruler and regxlationr. Appropriate application materialr <br />should be submitted to the Offzce of State Engineer for the permanent structures. State engineer and DMG <br />approval rhall be obtained b fare Phare III bond release can occur. Pleare moire Appendix 13-9 accordingly. <br />Response: Seneca Coal Company (SCC) has constructed 21 Temporary stock tanks in the reclaim <br />areas at the Seneca II mine. SCC has reviewed the need and design for each of these structures to <br />determine whether they should be retained as permanent or be reclaimed. The results of this review <br />indicate that a number of the structures should be reclaimed. <br />STOCK PONDS TO BE RETAINED STOCK PONDS TO BE <br />AS PERMANENT STRUCTURES RECLAIMED <br />T-4, T-8, T-16, T-17, T-2Q T-26, T-28, T-29, T-1, T-2, T-3, T-5, T-6, T-7, T-9, T-1Q T-Il, T- <br />T-30, T-31, T-32, T-33 12, T-13, T-15, T-25, <br />The purpose of this evaluation is to demonstrate that existing stock ponds T4, T8, T16, T17, T20, <br />T26, T28, T29, T3Q, T31, T32, and T33 meet the design criteria specified in the Regulations of the <br />Colorado Mined Land Reclamation Boazd (Rule 4.05.9) far permanent impoundments. <br />Appendix 13-9, Stock Tank Design, has been revised and includes text, drawings, SEDCAD4 <br />printouts, and certifications.
