NOTICE OF PROPOSED DECISION <br />The Colorado Division of Minerals and Geology proposes to Approve Technical Revision Application <br />No. 28 (TR-28) for the Bear Mine (Permit No. C-1981-033), submitted by Beaz Coal Company, Inc.. In <br />Technical Revision No. 28, the Bear Coal Company is proposing to discontinue the hydrologic <br />monitoring of three natural springs in the Lone Pine Gulch azea. The Beaz No. 3 Mine is a reclaimed mine <br />that ceased miuing operations in late 1996. The Beaz Coal Company has not mined in the Lone Pine <br />Gulch azea for about ten years. Other hydrologic monitoring at the Beaz No. 3 Mine will continue. <br />The Beaz Mine is an underground coal mine located in Gunnison County, approximately 0 miles east of <br />Somerset. Coal interest is Federal, and the surface affected is Federal and private land. The pernut area <br />encompasses approximately 1,108.40 acres. <br />This proposed decision is based on a finding that the proposed operafion will comply with all <br />requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S., <br />and the regulations promulgated thereunder. <br />Copies of the proposed decision, including stipulations, aze on file for public inspection at the Colorado <br />Division of Minerals and Geology, Room 215, Centennial Building, 1313 Sherman Street, Denver, <br />Colorado 80203. Persons with an interest that may be adversely affected by the proposed decision may <br />request a formal hearing before the Mined Land Reclamation Boazd on the proposed decision. Such <br />request must be made within ten (10) days of the initial publication of this notice, must be in writing, and <br />must state with reasonable specificity the reasons for the request and the objections to the proposed <br />decision. <br />
