i <br />Mr. Robert Hagen <br />-2- <br />November 15, 1990 <br />Vegetative cover along with other applicable standards must still be achieved <br />during the tinal two years of the liability period, in order for the <br />reclamation to quality for Phase III bond release. 100 of the revegetation <br />costs were retained, and thus sufficient funds would be available to <br />reestablish vegetation pursuant to Rule 3,03.1(3)(a) even if a total <br />vegetation failure were to occur during the liability period. <br />A primary consideration in any bond release decision is the requirement of <br />Rule 3.03.1(3)(d) which states that the "Division shall not release any <br />liability under performance bonds applicable to a permit if such release woulo <br />reduce the total remaining liability under perfiormance bonds to an amount less <br />than that necessary for the Division to complete the approved reclamation <br />plan". The Division has estimated the potential remaining liability amount to <br />be 5101,000.00. Upon release of 85~ of the original bond amount, we will <br />retain bond of over b111,000.00.
