A primary consideration in any bond release decision is the requirement of Rule 3.03.1(3)(d) which states that the "Division shall not release any liability under performance bonds applicable to a permit if such release woulo reduce the total remaining liability under perfiormance bonds to an amount less than that necessary for the Division to complete the approved reclamation plan". The Division has estimated the potential remaining liability amount to be 5101,000.00. Upon release of 85~ of the original bond amount, we will retain bond of over b111,000.00.
