Lnnµ <br /> Dwismn Di.eanr <br />Re: Apex No. 2 Mine, Permit No. C-81-011 <br />Permit Renewal RN-03, Preliminary Adequacy Review <br />Dear Mr. Lewicki: <br />The Division has completed its preliminary review of the application materials that you <br />submitted for renewal of the above-referenced mining permit. <br />Please respond to the following questions and submit the requested revisions, keeping in mind <br />the Division's proposed decision date of April 10, 1998. To meet this deadline, you will need to <br />allow sufficient time for any additional review and responses. <br />Please beaz in mind that the complete renewal application was submitted less than 180 days <br />before the permit expiration date of May 26, 1998 and, therefore, pursuant to Section <br />2.08.5(3)(f), the permittee does not have the right to successive renewal. Continuation of the <br />permit beyond the expiration date depends on the outcome of the current renewal application <br />review process. It is imperative that this renewal process, including the Division's issuance of a <br />proposed decision, be completed by April 10, 1998. This deadline allows for the decision's 30- <br />day public comment period to elapse prior to the May 26, 1998 permit expiration date. <br />The Division may have additional questions and require additional revisions following your <br />response to this preliminary review. <br />Page 1, 2nd paragraph. The next to the last sentence in this pazagraph says the total <br />surface disturbed area is 3.1 acres. Please resolve the apparent inconsistency with page 3 <br />of the Renewal Application form which says the disturbed area is 4.12 acres. <br />2. Page 4A. This page shows that Costain America, Inc. now owns 100% of Sunland <br />Mining Corporation. Page 1 of the existing permit shows that prior to submittal of this <br />permit revision Costain Coal Inc. owned 100% of Sunland Mining Corporation. If <br />Costain Coal Inc. is still in the ownership chain of Sunland Mining Corporation, then <br />please insert the ownership and control information for Costain Coal Inc. at the proper <br />
