6. Response acceptable. <br />7. The 1995 DMG determination that the Ike Mine in the Slick Rock District is not a Designated <br />Mining Operation was based on several factors that do not apply here at the SM-18 Site (see <br />April 28, 1995 letter from DMG to Cotterl. At issue here is that Cotter is proposing a new <br />waste rock dump and ore stockpile area. These piles have potential to expose toxic forming <br />materials. Cotter has not adequately demonstrated that the mined material to be exposed or <br />disturbed lacks sufficient quantities of toxic-forming material to adversely affect human health, <br />property, or the environment. <br />Similar to the Ike No. 1 determination, DMG requires Cotter to: <br />a) Notify DMG within 30 days of deposition of waste rock and/or ore at the surface; <br />b) collect and analyze, using SPLP analysis or other acceptable method, a representative <br />sample of waste rock material prior to, or during initial deposition at the surface; <br />1) The frequency of sample collection and testing methodology will be agreed to <br />by DMG and Cotter prior to initiating the program; <br />21 Cotter will submit test results of the waste rock material to DMG within 30 <br />days after tests are complete. <br />c) collect and analyze, using SPLP analysis or other acceptable method, a representative <br />sample of mined ore prior to, or during initial deposition at the surface; <br />1) specify a maximum residence time for stockpiled ore on the surface within the <br />affected area and demonstrate, using SPLP analysis or other acceptable <br />method, that within that specified residence time the ore material is not <br />capable of producing materials which contain detrimental amounts of chemical <br />constituents such as acids, bases, or dissolved metals. <br />21 The one time sample analysis results will be submitted to DMG within 30 days <br />of receipt by Cotter along with a proposal for the ore residence time. <br />Please contact Harry Posey at the DMG Denver Office to determine acceptable testing <br />methods and sampling frequency. <br />8.
