• . iii iiiiiiiiiiiu iii <br />999 <br />August 3, 2001 <br />Memo to the File <br />Red Canyon Quarry, M~-1,9~85-043 <br />From: James Dillie ~U - <br />Received a phone message from James Lockhart, Sierra Club, on August 2, 2001 requesting <br />information about the process to submit a request for a reconsideration of a Board decision. <br />I called Mr. Lockhart on August 3, 2001 and informed him to comply with Rule 2.9 if he <br />intends to request a reconsideration of the Board's decision. Or, if the Sierra Club intends to <br />seek judicial review of the Board's decision, I instructed him to review the requirements of <br />the State Administrative Procedure Act, 24-4-101. <br />Mr. Lockhart inquired about the deadline for submittal of the reconsideration request. I told <br />him the deadline is 10 working days from the receipt, by the Petitioner, of the Board's <br />written decision (per Rule 2.9.2). He said the Board's written decision (signed on the 20"' of <br />July; the same date of the Certificate of Service) was post-marked on July 25"' and that he <br />received the letter on July 28, 2001. I told Mr. Lockhart that if, in fact, he received the <br />Board Order on July 28, 2001, the 10 working day deadline for submittal of a <br />reconsideration request would expire on August 10, 2001. This situation was discussed with <br />Mr. Humphries wherein he agreed that the deadline date should be set for August 10`~ if Mr. <br />Lockhart can demonstrate that the Board Order was not received until July 28"' <br />Mr. Lockhart said he is not sure if the Sierra Club will submit a request for reconsideration. <br />He is considering all his options and just wanted to know what the deadlines were. <br />cc: H.
