Since the Fish and Wildlife Service has no direct power to <br />require completion of a habitat conservation plan as a condition to the operation of the <br />quarry under a state permit, we feel that it is necessary for protection of the environment, <br />and to carrying out of the Mined Land Reclamation Board's obligation to protect wildlife <br />resources, that the Board incorporate such a requirement into its permit. <br />We continue to be concerned whether the Colorado Water Conservation Board is <br />ready, willing, and able to provide the consultation specified in Protective Condition 2. <br />One of our members, Larry Skiffington, Esq., had attempted on several occasions to <br />contact the Water Conservation Board by telephone, and has twice visited their offices in <br />person, providing them with a detailed explanation of the MLRB protective condition and <br />our need for confirmation prior to the MLRB hearing that the Water Conservation Board <br />could carry out the role requested of it. Other than a brief telephone message left by <br />Deputy Director Dan McAuliff, we have received no reply to our requests. Mr. <br />McAuliff's message did not state whether the applicants or Division of Minerals and <br />Geology has been in touch with the Water Conservation Board, or whether the Board <br />would able to assist the applicant in the manner described in the Protective Condition. <br />This leads us to believe that this matter is unresolved. The Mined Land Reclamation <br />Board, in absence of new or additional information regarding the Water Conservation <br />Board's intentions and ability to carry out its proposed role, must reconsider Protective <br />Condition 2. <br />James E.
