LnnR <br />Uivisinn Duer'tor <br />The Division received your letter dated October 24, 1997 on November l0, 1997. You stated in your <br />letter that there is a cliff at the Coaldale Quarry which you feel is dangerous, unstable and a threat to <br />wildlife and people. You estimate the cliff to be 40 feet or higher and approximately 200 feet long. You <br />did not say whether the cliff is inside or outside the Coaldale Quarry permit area. <br />in addition, you did not say if you reviewed the proposed amendment application. If you take a few <br />minutes and review the amendment application (at the County Clerk and Recorder's Office in Canon <br />City) you will see that the operator proposes to drill and blast all highwalls, within the permit area, to a <br />stable 1:1 slope. The newly created slopes will be revegetated at the top and the toe with an array of <br />shrubs, grasses and tree species. The slopes will have to be stable in order to receive a release of <br />reclamation responsibility from the Mined Reclamation Board. Also, those areas of affected land within <br />the permit area that are not drilled and blasted will have to be topsoiled (growth medium) and <br />revegetated. <br />Areas outside the permit area that were disturbed prior to the enactment of the Mined Land Reclamation <br />Ac[ (and Mineral Rules and Regulations) are considered pre-law and, unless they are re-disturbed, are <br />not required to be reclaimed under existing statutes. The map you submitted shows the cliffs location. <br />From your description, it appears the cliff may be located on Titanium Hill. There is a portion of <br />Titanium Hill that was disturbed before the Mined Land Reclamation Act was enacted so, therefore, it <br />may be pre-law disturbance. <br />1 suggest you review the amendment application, and all revisions (a revision will be filed with the Clerk <br />and Recorder in the next few weeks), and attempt to locate [he cliff on one of the permit exhibit maps. If <br />you are still not satisfied with the proposed reclamation plan, once you determine that the cliff is in the <br />permit area, please send another concern (or objection) letter. <br />Weather permitting, I will be at the site on November I8, 1997 to conduct apre-operation inspection. 1 <br />plan to meet with Mr Thomas Brooks and Mr Ken Klco (G-P representatives). lanticipate being at the <br />site a[ approximately 9:00 AM. If you are still concerned with the cliff maybe you should join the <br />meeting. I will notify Mr Brooks and Mr Klco that you may want to participate in the inspection. <br />If you have any questions, please give me a call. <br />
