Simpson, P.E. <br />State Engineer <br />CONDITIONS FOR APPROVAL <br />® The purpose of the amendment is to add a 7.74-acre parcel to the permit area to enable the operator to <br />mine an additional cell #~ 0 of approximately 6 acres. <br />® The proposed operation will consume ground water by: ®evaporation, ®dust control, ®reclamation, <br />® water removed in the mined product, ®processing, ®other: dewatering. <br />Prior to initiation of these uses of ground water, the applicant will need to obtain either a gravel pit or <br />other type of well permit, as applicable. However, prior to obtaining a permit, an approved water supply <br />plan or decreed plan for augmentation is required. The existing substitute water supply plan for the <br />Lorimer Pit expired on February 28, 2006. A renewal request for a substitute water supply plan was <br />submitted on January 18, 2006 and this plan is pending evaluation. <br />® A well permit was obtained for the current use and exposed pond surface area of the gravel pit, permit <br />no. 62009-F in accordance with Section 37-90-137(2) and (11), C.R.S. The applicant may be required to <br />obtain a new well permit if the proposed mining of cell #10 will expand the uses allowed under permit no. <br />62009-F. <br />^ The proposed operation may have potential impact on existing water rights near the project location. <br />Applicant needs to demonstrate that the proposed project will not alter or impact the historic operation of <br />existing water rights. <br />^ The applicant has indicated plans to use other water for purposes at the permit site. The source <br />of water for this use is to be obtained from Applicant needs to document that this water was <br />diverted in priority under a water right decreed for such industrial use. Applicant should contact the <br />water commissioner for further information. <br />® An augmentation plan for the Lorimer Pit site was filed with the Division 1 Water Court in Case No. <br />2000CW143. Loveland Ready-Mix Concrete, Inc. has also obtained storage water rights in Case No. <br />98CW431 for storage in two of the pits within the site, identified as pit 16 and 17. <br />COMMENTS: If stormwater runoff is intercepted by this operation and is not diverted or captured in priority, it <br />must be released to the stream system within 72 hours. This may require a discharge permit from CDPHE- <br />WOCD. Otherwise, the operator will need to make replacements for evaporation. <br />The applicant may contact the State Engineer's Office with any questions. <br />
