s <br /> <br />Mr. Larry Oehler February 8, 2000 <br />Division of Minerals and Geology <br />Re: File M-79-158, Mountain Shadows,Pit F <br />1313 Sherman Street, Room 215 ~ Rr--- "-' ~/ED <br />Denver, CO 80203 FEPy 2000 <br />Dear Mr. Oehler: <br />Division ~~ ~~~~,,;.".,~ ° ueolo9y <br />I am writing to obje~to the application submitted by the Colorado City <br />Metropolitan District (CCMD) as noted in filing M-79-158, Mountain Shadows Pit. <br />We are the landowners of Mountain Shadows parcel #22, our address is 10500 <br />Dodge Road, Rye which is''/z mile from the parcel #14 in question. The purpose <br />of the appligtion by CCMD is to expand its current 9.9 acre (lot #15) gravel pit to <br />81 acres (lot #14). <br />Our opposition to this application is based on a variety of wncerns to my family. <br />First and foremost from a legal aspect is~the clear violation of the terms of the _ <br />strict covenants of which all landowners in Mountain Sha~c ow Estates must abide. <br />Lnt #15 is exempt from.these strict use provisions of the covenants. 'Th J ; ~ , <br />covenants do not provide for mining on lot #14. ~ If this application is granted--' <br />why's to stop other Mountain Shadow Estates lot owners to also begin <br />breaching their contractual obligations as landowners in this community. It <br />breaks down the very tenants for which many of us purchased in this area - a <br />safe and peaceful environment to raise our families. <br />Which brings me to the real impact of the expansion of this pit in my own back <br />yard. I have three young girls who frequently ride their bikes down Greenhorn <br />Road ,which is the access road to the pit. Just this morning, in the time it took to <br />get my paper in my mail-box 4 tandem gravel trucks went barreling past me z <br />heading to the pit. ~flnc~eased gravel extraction in this area poses a real threat tom <br />the-safety and well being of the families,~Nrho- for those very quality of life issues- <br />chose to settle in this rural development of Pueblo county. _ <br />(. ~ S ,, k ~ <br />There are additional issues of[devalued property ust, oise and lack f <br />_ protection fo_r the beautiful_Graneros_~reely whic~ runs through many of our <br />residences! <br />I trust that the owners of Mountain Shadow estates -and their families -will be <br />afforded every consideration in this matter. <br />Sincere , <br />Greg Sinn <br />
