She wanted to clear up a <br />misconception concerning county permitting information that I had received from Gunnison County <br />one week earlier. The county permitting information I received and passed on to Bear Coal Company <br />(BCC) in the MR-27 adequacy review letter dated August 15, 2006 was relevant only for incorporated <br />azeas of Gunnison County. The Bear Mine No. 3 is in att unincorporated area so county permits and <br />approvals will not be required for certain reclamation activities. <br />The Division reiterates, however, that it is the responsibility of BCC to provide written documentation <br />to the Division as to whether or not Gunnison County hasjurisdiction over certain reclamation <br />activities. Therefore, questions numbered two and three of the Division's first adequacy review letter <br />for MR-27 need to be revised. The two revised questions follow: <br />2. In Beaz Coal Company's Midterm Review response letter dated July 26, 2006, which also <br />served as the cover letter for MR-27, BCC stated their belief that Gunnison County does not <br />have the authority to regulate burial of debris on site, a MR-27 issue, nor has the jurisdiction <br />concerning the reclamation status of the bridge over the North Fork of the Gunnison River, a <br />2005 Midterm issue. <br />Please provide written confirmation from Gunnison County as to whether or not the activities <br />proposed in MR-27 need county approval. [f county approval is needed, please provide that <br />approval to the Division. These proposed activities include demolishing or burning the mine <br />office, onsite burial of concrete [hat is free of organic matter and contamination, <br />decommissioning and reclaiming the sewage system and removing the power poles and <br />transformer. <br />It is the Division's understanding from our conversation with Gunnison County that Jon Lee of <br />the Ragged Mountain Fire Protection District (970-929-6575) needs to be contacted if BCC <br />decides to burn down the mine office building. <br />Office of Office of <br />Mined Land Reclamation Active and Inactive Mines <br />
