L <br />Susan J. Mowry <br />Page 3 <br />17s. Section 1 of the waste pile is not complete. <br />17b. The current volume of material in the waste pile is <br />unknown. Page 2.05-19 has bee revised to include a commitment to <br />provide the estimated volume, placed each quarter, in the quar- <br />terly certification report. <br />17c. The Operator has no estimate of the annual production <br />of underground development waste. The annual production of <br />underground development waste is a function of 1) roof conditions <br />in the mine; 2) the amount of roof or floor intentionally exca- <br />vated in the mine for the installation of overcasts or other <br />purposes and; 3) special projects such as ramping into another <br />seam. <br />17d. Page 2.05-19 has been revised to include a commitment <br />for quarterly monitoring of the stability of the pile by a regis- <br />tered engineer or other qualified professional. The Rules quoted <br />do not specifically require a compaction specification. The <br />Operator believes that the quarterly inspections of this small <br />pile will provide adequate assurance that the pile is being <br />constructed and maintained in a stable configuration. <br />17e. A new table of the results of the geochemical analyses <br />of the Bear underground development waste is enclosed as page <br />2.05-20iii. <br />I7f. The source of non-toxic cover is the material excavated <br />for that purpose as explained on page 2.05-19. <br />18. - 21. Appendix H has been revised to address these issues. <br />22. The soils testing plan was revised on page 2-05-22. <br />23. & 24. Appendix H has been revised to address these issues. <br />25. - 28. Not addressed in this transmittal. <br />29. Map E8-3292 was replaced by map E8-3398 which is con- <br />tained in Appendix C of TR-02. The replacement map does have a <br />key. <br />30. Pages 2.05-30 and 2.05-31 have been revised to describe <br />the operations planned in the stream buffer zone during the <br />reclamation of the lower Hubbard Creek Facility. <br />
