The revision was <br />submitted by Bowie Resources Limited. All review and comment periods as provided in the Act and the <br />Regulations initiate from this date of filing. <br />Approval of this technical revision would permit an incidental boundary change in order to conduct development <br />mining in federal coal. This technical revision can not be approved until Bowie Resources has secured Federal <br />Coal Lease COC-61209 for the right of entry to that federal coal. The incidental boundary change would add 169 <br />acres of private surface and 130 acres of federal surface to the northern portion of the permit area. All of the coal <br />to be mined is federal. There would not be any increase in the disturbance area, no additional facilities would be <br />built and there would not be any increase in productionthrough this revision. <br />The underground coal mining operation is on land located approximately 5 miles northeast of Paonia, Colorado. <br />The permit area is furtherdescribedas follows: <br />Portions of Sections 2, 3, 4, 9, 10, 11, 14, 15, and 16, Township 13 South, Range 91 W est of the 6th P.M. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Bowie. <br />Because the above referenced technical revision application would incorporate additional lands into [he permit <br />area or might otherwise alter previously approved permit conditions or mitigation measures, we are requesting <br />your agency's evaluation of [he potential for impacts to threatened or endangered species of plants or animals, or <br />wildlife species otherwise protected by' federal law. <br />In order for us to approve this revision, we are required to make a finding that "the activities would not affect the <br />continued existence of endangered or threatened species or result in the destruction or adverse modification of <br />their critical habitats as determined under the Endangered Species Act of 1973...." We request your review and <br />recommendation pursuant to this finding. A copy of the technical revision cover letter and a map are enclosed. <br />Please advise us if you require additional information. <br />
