<br />• Page 2 <br /> <br />May 24, 2000 <br />34. Twentymile Coal Company submitted revised page 2.05-76.2 (rev. 5/03/00) which addresses the Division's <br />concern. <br />51. This item has not been adequately addressed. <br />Based upon the Division's review of proposed Map 23, "Mine Plan" (certified 5/10/00), it is apparent that <br />portions of the following areas within TSN, R86W will be subsided by longwall mining operafions: <br />Section 11; W % Section 13; N''/Z Section 14; Section 16; and E''/x Section 17. <br />Rule 2.04.4(1) regains that a pemut contain a description of the cultural and historic resources listed or eligible <br />for listing on the National Register of Historic Places and significant known archaeological sites existing on the <br />date of application within all auras proposed or likely to be affected by surface activities or planned or probable <br />subsidence over the life of the mine. <br />A review of confidential exhibits 6, 6a-l, 6-C, 6D, 6a-l, 6-C, 6D, 6E, 6F, 6g, 6H and 6I, however, indicates that <br />surveys for the presence of cultural and/or historic resources listed or eligible to be listed on the National Register <br />of Historic Places and/or the presence of significant known archaeological sites have not been conducted for <br />these areas. <br />The Division is prohibited by Rule 2.07.6(2)(e) from approving a pemut revision unless the Division finds that <br />"the proposed operations will not adversely affect any publicly owned pazk or place listed, or eligible for listing, <br />as detemwred by the State Historic Preservation Officer, on the National Register of Historic Places, unless <br />approvedjointly by the Board and the Federal, State, or local agency with jurisdiction over the pazk or place". <br />So that this item may be addressed expeditiously, we recommend that TCC implement the following course of <br />action: <br />1. TCC sends a letter to the Colorado State Historical Preservation Officer, requesting the SHPO provide a <br />written response to TCC indicating whether there are any: <br />(a) cultural and/or historic resources listed, or eligible for listing, on the National Register of I-Iistoric Places, <br />and <br />(b) significant known archaeological sites, <br />existing within the following areas in TSN, R86W: Section 11; W '/~ Section 13; N % Section 14; Section <br />] 6; and the E '/z Section 17. <br />2.TCC provides a copy of the SHPO response to the Division as an Exhibit to the pemilt, along with proposed <br />perrrrit text for insertion into the existing permit pages 2.04-8 or 2.04-9 reflecting the responses provided by <br />the SI-II'O. <br />52. This item has not been adequately addressed. <br />The Division, in it's May ], 2000 adequacy Jetter, requested TCC to insert, into existing pemrit page 2.04-12 <br />
