Please be <br />advised that there are new application requirements based on rule changes <br />which became effective January 1, 1991, Those which pertain to the notice <br />requirements at the time of application submittal are noted below: <br />° Prior to submitting the application to the Division for filing, the <br />applicant shall send a notice, on a form approved by the Board, to the <br />local board of county commissioners and, if the mining operation is <br />within the boundaries of a soil conservation district, to the board of <br />supervisors of the soil conservation district (Rule 2.2.2(1)). <br />EXHIBIT R -Proof of flailing of Notices to County Commissioners and <br />of onserva ton is rtc roo o ac a e tvery or proo 0 <br />mat tng y cer t to mat return receipt requested, of notice of the <br />application to the local board of county commissioners and, if the <br />mining operation is within the boundaries of a soil conservation <br />district, to the board of supervisors of the soil conservation <br />district (forms enclosed) (Rule 2,1.2(18)). <br />° EXHIBIT S -Proof of Filing with_Cou_nty Clerk and Recorder: An <br />a~fii avt or recetp~t~ic~ing e a e on w tcfi- a app ication was <br />placed with the local county clerk and recorder (Rule 2.2.1(19)). <br />Failure to follow these notice requirements will result in a decision to deny <br />your application. You may amend your application by submitting proof of these <br />notices, In accordance with Rule 1,5, a new decision date will be established <br />90 days from the date of receipt of these notices. If you have already <br />initiated publication, you will need to republish notice which specifies the <br />final date for receiving camnents is the 20th day after the fourth publication <br />or the next regular business day, <br />
