Long <br />Division Director <br />RE: Adequacy Letter, TR-021, San Luis Project, Permit No. M-88-112 <br />Dear Ms. Hayes: <br />The Division received and reviewed BMRI's Emergency Response Plan for the designated <br />mining operation. There are only a few items that need to be addressed in order to fully comply <br />with Rule 8: <br />1) You state in Paragraph 9.3, page ]0, of your ERP that BMRI will immediately <br />report all spills or situations that represent a potential threat to human health, <br />property or the environment. Pursuant to Rule 8.1, the operator shall notify the <br />Office, as soon as reasonably practicable, but no later than twenty-four (24) <br />hours. Please make the necessary changes to the ERP reflecting the requirements <br />of Rule 8.1 and 8.2.1. <br />2) Your ERP does not specifically address the requirements of Rule 8.3.2 and 8.2.3. <br />Your written agreement to comply with these subsections of Rule 8 is all that the <br />Division requires. <br />The decision due date for this TR is March 6, 1995, so a copy of this letter will be faxed to <br />your office.
