4.11.4 Disposal of Noncoal Waste. <br />120(2)(k) (1) Noncoal wastes including, but not limited to, grease, lubricants, paints, <br />121(2)(c) flammable liquids, garbage, abandoned mining machinery, ]umber and <br />other combustibles generated during surface or underground mining <br />activities shall be placed and stored in a controlled manner in a <br />designated portion of the permit area. Placement and storage shall <br />ensure that leachate and surface runoff do not degrade surface or ground <br />water, fires aze prevented, and that the area remains stable and suitable <br />for reclamation and revegetation compatible with the natural <br />SUIrOUItdIIIgS. <br />(2) Final disposal of noncoal wastes shall be in a designated disposal site <br />in the permit azea or in aState-approved solid waste disposal azea <br />outside the permit area. Disposal sites located within the permit azea <br />shall be constructed to ensure that leachate and surface runoff do not <br />degrade surface or ground water, fires are prevented, and that the area <br />remains stable and suitable for reclamation compatible with the natural <br />surroundings. Wastes shall be routinely compacted and covered to <br />prevent combustion and wind-born waste. When the disposal is <br />completed a m;n;mum of 2 feet of soil cover shall be placed over the <br />site, slopes stabilized, and revegetation accomplished in accordance with <br />4.15. The Division may allow less than 2 feet of cover material based <br />on physical and chemical analyses which show that the requirements of <br />4.15 will be met. Operations of the disposal site shall be conducted in <br />accordance with the local, State and Federal requirements. <br />(3) At no time shall any noncoal mine waste be deposited in a refuse pile <br />or impounding structure, nor shall any excavation for noncoal mitre <br />waste disposal be located within 8 feet of any coal outcrop or coal <br />storage area. <br />4.11.5 Dattts and Embankments. <br />(1) General Requirements. <br />12o(2)(m) (a) 4.11.5 applies to dams and embankments, constructed of coal mine <br />121(2)(e} waste or intended to impound coal mine waste, whether they were <br />completed before adoption of the regulatory program or aze <br />intended to be completed thereafter. <br />(b) Waste shall not be used in the construction of dams and <br />embat>lanents unless it has been demonstrated to the Division that <br />the stability of such a structure conforms with the requirements of <br />4.11.5(3)(a). It shall also be demonstrated that the use of waste <br />material shall not have a detrimental effect on downstream water <br />quality or the enviromnent due to acid seepage through the dam or <br />embanlanent. All demonstrations shall be submitted to and <br />approved by the Division. <br />(c) All dams and embattkments constructed of or impounding coal <br />mine waste are subject to the general coal mine waste bank design, <br />construction,~certification, inspection and maintenance require- <br />ments of 4.10 and the additional requirements of 4.11.5. <br />(d) Dams and embankments constructed of or impounding coal mine <br />waste may not be retained nermanendv as imooundinQ structures. <br />
