<br />KERB COAL COMPANY <br />TIPPLE RECLAMATION <br />III IIIIIIIIIIIII III <br />999 <br />Given the pending sale of the property to a private party for use as a camping and recreational <br />vehicle park and practical constraints which limit the ability to implement previously approved <br />reclamation plans for the Kerr Tipple Area, Kerr is proposing several revisions to the approved <br />reclamation plans for this area. The proposed changes aze outlined in the following sections <br />and would require submittal and approval of a Minor Revision to the existing approved Kerr <br />Permit. <br />POSTMINING LAND USE CHANGE <br />Kerr is currently finalizing negotiations with a buyer for the tipple area who plans to construct <br />a camping and recreational vehicle park on the site. This proposal will require a change in the <br />postmining land use from grazing and wildlife habitat to industrial. In conjunction with this <br />proposed use, the buyer desires to retain the existing paved road for access and the Shop/Utility <br />building, eliminating the need for disposal of paving material and demolition debris from the <br />Shop/Utility building. IE desired, Kerr can pcovide a confirmation letter from the prospective <br />buyer. <br />FACILITY DEMOLITION AND MATERIAL DISPOSAL <br />The originally approved reclamation plan for the Kerr Tipple Area proposed that paving <br />materials from the Tipple Access and Haul Road, concrete and steel debris resulting from <br />demolition of the Tipple Facilities, and any remaining coal and coal fines be removed from the <br />Tipple Area and disposed of in either a remaining open pit area at the Kerr Mine or in the <br />Jackson County Landfill. With early cessation of mining activities and subsequem closure and <br />reclamation of mine disturbance areas, mine pit areas were eliminated as a potential disposal sice <br />for these materials. Recognizing this limitation, the DMG requested that the Tipple <br />reclamation plans be reviewed and modified to address material disposal. <br />In a partial bond release application response submittal to the DMG in March 1995, Kerr <br />proposed chat solid wastes generated by demolition of the Tipple Facilities be disposed of by <br />burying these materials on-site and covering them with suitable material rather than <br />transporting them to the Mine Area for disposal as previously proposed. This proposal is <br />documented by Response 11 (attached for reference) and the Loadout Area Postmining <br />Topography Map, (Map 36), which designates a "Solid Waste Disposal Area". Given that the <br />partial bond release was approved without any stipulations regarding this proposal, it has been <br />assumed chat the proposal was accepted by the DMG. <br />The partial bond release response indicates that concrete demolition debris will be disposed of <br />in the Tipple Area and that equipment and steel demolition debris and coal materials will be <br />hauled off-site for salvage or disposal in the Jackson County Landfill but does not address <br />disposal of paving materials. Very limited capacity remains in the Jackson County Landfill <br />(which is slated to close in the near future) with preference being given to disposal of municipal <br />solid wastes from the Town of Walden for the remaining capacity. It is, therefore, appropriate <br />and necessary to identify practical alternatives for disposal of the remaining demolition debris <br />from the Kerr Tipple Facilities. <br />In addition to disposal of concrete demolition debris, other solid waste materials could be <br />disposed of in the Tipple Area. Potential disposal sites include the sub-grade portion of the <br />Il''1All1Al)Ip..rt <br />
