Long, Director <br />Division of Minerals and Geology <br />Department of Natural Resources <br />1313 Sherman Street <br />Room 215 <br />Denver, CO 80203 <br />Re: Colowyo Mine (C-81-019) Phase I Partial Bond Release <br />Dear Mr. Long, <br />REC-- Ei-_ <br />OC7 5 iggg <br />DIV OF tu- i_ r,i~ c~~' <br />This letter serves as the Office of Surface Mining's (OSM) concurrence on the proposed Phase I <br />partial bond release for the Colowyo Coal Company's Colowyo Mine, Division of Minerals and <br />Geology (DMG) permit number C-81-019. OSM would like to clarify that while DMG has <br />referred to this release as a Phase I and partial Phase /1 bond release, OSM only concurs with the <br />Phase I portion of the bond release. OSM believes this clarification is necessary because the <br />DMG proposed decision could be interpreted to state that certain lands have met a part of the <br />Phase II release requirements and as such are granted a bond release for that one part of the Phase <br />II bond release requirements. OSM only concurs with any Phase bond release where all of the <br />requirements of the Phase bond release are met. <br />DMG complied with the bond release inspection requirements contained in the Colorado Rules, <br />including publication and notification to landowners and interested parties. The inspection was <br />conducted on December 22, 1997. Representatives of OSM and the U.S. Bureau of Land <br />Management were unable to attend. DMG issued a proposed decision on April 27, 1998, and <br />revised page 18 of that decision on May 11,1998. BLM issued a letter of concurrence with the <br />DMG revised proposed decision on May 19, 1998.
