Long <br /> Division Director <br />RE: Technical Revision No. 35 Adequacy Review; <br />Seneca II Mine (Permit No. C-80-005) <br />Dear Mr. Shevling: <br />The Division has reviewed Seneca Coal Company's (BCC's) responses to the Division's <br />Comment 7 in our October 22, 2001 adequacy review letter regarding the permit renewal <br />RN04 application. Comment 7 was addressed by SCC as Technical Revision No. 35. The <br />Division has the following comments with regard to the TR-35 submittal. <br />1 a. It appears that many of the existing stock ponds do not meet the design criteria as <br />specified in the approved permit document. Appendix 13-9 specifically states that all <br />stock tanks will be constructed according to State of Colorado, Office of State <br />Engineer's "Specifications to Govern the Construction of a Livestock Water Tank" and <br />USDA Soil Conservation Service's specifications for tanks. Many of the stock ponds <br />do not meet the requirements for one or both of these documents. The Division <br />recommends that SCC revise Appendix 13-9 to remove reference to the USDA Soil <br />Conservation Service's specifications, and to state that all impoundments both <br />temporary and permanent will meet the design criteria specified in the Regulations of <br />the Colorado Mined Reclamation Board (Rule 4.05.9). All impoundments that are <br />intended to be retained as permanent postmining features shall comply with applicable <br />state engineer rules and regulations. Appropriate application materials should be <br />submitted to the Office of State Engineer for the permanent structures. State engineer <br />and DMG approval shall be obtained before Phase III bond release can occur. Please <br />revise Appendix 13-9 accordingly. <br />lb. To demonstrate compliance with Rule 4.05.9, please provide the following design <br />information for the temporary impoundments T-1 through T-13. <br />• Demonstration that the impoundment spillway systems are designed for the 25- <br />year, 24-hour precipitation event. <br />
