Simpson, P E. <br />State Engineer <br />The Division of Water Resources has reviewed the Bowie No. 2 Mine (Permit No. C- <br />1996-083), Technical Revisions Application No. 47 (TR-47) for the Hubbard Creek Vent <br />Shaft and Incidental Boundary Change. The application proposes to construct a <br />ventilation shaft and increase the permit area by 19.2 acres. In addition, the application, <br />submitted on March 20, 2007, indicates that the applicant proposes to construct a new <br />sediment pond (e.g., HC sediment pond) with a dead storage of 0.03 acres which <br />produces evaporative losses of 0.08 acre-feet per year. Other ponds exist on the <br />property. Cumulative total evaporative losses of 5.2 acre-feet from all ponds are <br />included in the approved facility's augmentation plan. The application proposes that <br />cumulative evaporative losses including those of the HC sediment pond would be <br />reduced to 4.88 acre-feet. The application also provides that the total estimated water <br />consumption would be reduced from 323.8 to 323.5 acre-feet. The SEO has not been <br />able to confirm the depletions described above in any court cases. Specifically, HC <br />sediment pond described in the Technical Revisions Applications No. 47 can not be <br />identified in a decreed court case.
