Since it has not been <br />constructed, it is not burning and, consistent with applicable provisions of 30CFR 77.215, no <br />burning material will be placed on or added to the proposed coal refuse pile. In addition, the <br />proposed coal refuse facility has been located so that it is not over or in close proximity to any <br />coal seams or coal seam burn areas. <br />61 Measures to Prevent Impoundment of Water by_or Within Refuse Facility <br />The II West Coal Refuse Facility has been designed and will be constructed, operated, and <br />reclaimed in full compliance with applicable provisions of Rules 4.9 and 4.]0 of the Colorado <br />Mined Land Reclamation $oard Regulations for Coal Mining. These provisions include; <br />designed diversions to intercept and route any upgradient drainage and potential run-on around <br />the coal refuse facility; grading of coal refuse pile surfaces and outslopes to effectively drain <br />runoff off the pile surface; perimeter collection ditches to collect and route runoff from the coal <br />refuse facility and adjacent hillslopes to a sedimentation pond located beyond the lower toe of <br />the coal refuse pile; and a designed rock underdrain to collect and drain off any seepage or <br />infiltration through the pile.
