Allyn Davit <br />Mine Safety and Healtb Admini.rhation <br />Ortolnr 1Q 2003 <br />Page 3 <br />• Complete geotechnical stability evaluations for designed refuse pile configuration <br />• Prepare, submit, and obtain approvals for required project permits <br />CDMG Technical Revision <br />UP Raikoad Pipeline Crossing Permit and Lease For Facilities within Railroad ROW <br />MSHA notifications <br />• Clear and grub large vegetation and salvage available soil and suitable material and remaining <br />vegetation, as well as lazge rocks, from road, ditch, sedimentation pond, and initial pile <br />footprint areas <br />• Establish road access to and within the refuse pile area <br />• Establish upgradient clean-water diversion(s) to intercept and route undisturbed drainage <br />around the refuse pile azea <br />• Construct designed concrete pond embankment and discharge structures <br />• Constmct perimeter collection ditch(s) and excavate sedimentation pond basin to collect and <br />control disturbed area drainage and sediment from the refuse pile area <br />• Constmct initial section of underdtain using salvaged rock materials or select granular <br />material and appropriate fiber fabric <br />• Selectively place and compact coal mine refuse materials in successive horizontal lifts <br />(maximum 2-foot thick, compacted to 90 percent of maximum dry density) consistent wi[h <br />design specifications and to the design elevation for each bench (successive benches to be <br />constructed in the same manner) <br />• Grade bench outslope and surface to final configuration (maximum 2H:1 V slopes, note that <br />reclamation will be ongoing with progressive redamation of each fill bench as it is completed) <br />• Place a minimum of 4 feet of suitable (non-toxic, non-combustible) cover material on the <br />regraded surfaces and seed to establish permanent vegetation <br />MSHA Compliance and Jurisdictional Considerations <br />The proposed II West Coal Refuse Facility and associated Sedimentation Pond E aze located at an <br />elevation of approximately 6,200', compazed with a portal elevation of approximately 6,310' for the <br />Elk Creek Mine (the closest mine portals). The proposed facilities are at a level which is <br />stratigraphically below the minable coal seams in the azea. They aze also approximately 3,520' from <br />the closest mine portals, 4,550' from the closest mine ventilation shafts, and 2,850' from the closest <br />mine surface facilities and tipple, as shown on the General Location Map (Figure 1). The proposed <br />coal refuse facili[y and sedimentation pond do not overlie abandoned mine workings, steamlines, coal <br />seams, or coal seam burn areas. These facilities would be accessed through the OMLLC Surface <br />Facilities area, which is posted, limiting access to authorized persons. <br />
