<br />Elimination of Required Submittal of Erosion Report and
<br />Elimination of prior DMG Approval for Routine Erosion Repairs
<br />Deaz Mr. Johnston:
<br />Tile Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 116, Pazagraph 4,
<br />of the Colorado Revised Stawtes, that on April 1, 2003, an application to revise coal mining operations at the Edna Strip Mine
<br />was considered complete for the purposes of filing. The revision was submitted by Pittsburg & Midway Coal Mining Co.. All
<br />review and comment periods as provided in the Act and the Regulations initiate from this date of filing.
<br />The operator proposes to eliminate the pemlit requirement to submit an aanual erosion report to the Division. Also, the
<br />operator proposes to eliminate the requvement to obtain Division approval before conducting routine repairs of erosion
<br />damage.
<br />The Surface coat mining operation is on land located approximately 5 miles Northwest of Oak Creek, Colorado. The permit
<br />azea is further described as follows:

<br />TSN, R86W, Portions of Section 36
<br />T4N, R86W, Portions of Sections 12, l3, 14, 23, 24, 25
<br />T4N, R85W, Portions of Sections 7, 8, 17, 18, 19, 29, 30

<br />The applicant is required to publish notice in a local newspaper that this application has been deemed complete. At the time of
<br />publication of this notice, the applicant is additionally required to place a copy of this application at the Routt County
<br />Courthouse, P.O. Box 773598, Steamboat Springs, CO 80477, and at the Division office. For additional information or to
<br />provide written comments, contact the Division of Minerals and Geology, Room 215, 1313 Sherman Street, Denver,
<br />Colorado 80203, (303) 866-3567. In order for us to comply with regulatory time frames, we request that comments be
<br />submitted within fifteen (IS) days of this letter. If no comments aze received by then, we will proceed on the assumption that
<br />you have no concerns with, or objections [o, [he applicant's proposal.
