BOX 670 Natural Resource Trustee <br />Hayden, CO 81639 <br />Re: Seneca II Mine (Permit No. C-80-005), Technical Revision No. 37 <br />Office Of The State Engineer Response to Permanent Impoundment Proposal <br />Deaz Mr. Karo: <br />The DRMS received a memorandum from the Office Of The State Engineer (SEO) in response to <br />Seneca Coal Company's pump installation proposal for Ponds 002, 003, and PECOCO to allow <br />for the release ofout-of-priority inflows. Enclosed please find one copy of the memo from Craig <br />M. Lis, P.E. of the SEO. This memo was received by the DRMS on August 31, 2006. The SEO <br />indicates that the installation of pumps would be acceptable at this time for Ponds 002, 003, and <br />PECOCO. As previously indicated by the SEO the siphon method is an acceptable remedy for <br />Ponds 004 and 008. <br />Please submit appropriate revised pages to the permit document regazding leaving pumps at <br />Ponds 002, 003, and PECOCO to allow the release ofout-of-priority inflows and the out-of- <br />priority inflows that replace evaporative losses, if required. Landowners should be fully <br />informed of any operation and maintenance requirements associated with these permanent <br />impoundments. <br />Thank you for your cooperation.
