III IIIIIIIIIIIIIIII
999
STATE OF COLORADO
Roy Romer, Governor
DEPARTMENT OF NATURAL RESOURCES
MINED LAND RECLAMATION DIVISION
DAVID C. SRELTON, Dlreetor
October 1, 1987
Mr, Stamper Collins
Western Slope Carbon, Inc.
P,O. Box 3046
Joplin, Missouri 64803
Re: Letter of September 24, 1987
Dear Mr, Collins:
I regret that you perceived in such negative light the letter I sent to the
state of Missouri, I clearly did not intend it to be so. The letter
contained much of the same content and language as the letters we sent to the
citizens who support .your project and as the press release. The content of
those letters and the press release were discussed with you and Rebecca
Kourlis and you concurred in their content. Our intent with the letter to
Missouri was to be as objective as possible; as such we virtually copied the
phrases and language in the law, The letter was copied to Robert Liddle and
Sue P4owry of my staff, nary Behrns, the Program Supervisor in Missouri, and
Sandra Stratton, the assistant Attorney General for Missouri,
As you may appreciate, our approval of the transfer of permit to Blue Horizon
Mining, Inc. was a delicate matter, The state of Missouri advised against the
approval, but understood that we were acting within the framework of Colorado
law when we approved it. Since they were involved in the process, it was
necessary to notify them of the Division's decision.
We have made it clear to the state of Missouri, as we have to you, that
Colorado makes no judgments about the case in Missouri,
I sincerely hope that the Missouri issues can be resolved and that the
condition placed on your permit can be removed in the near future. It would
be to the benefit of both Colorado and Blue Horizon Mining, Inc. if this were
accomplished. I also hope that the positive relationship you have developed
with my staff continues, I join in that effort.
If you have any questions, please calf me.
Si rely, ~
., ~~
'O. rector
FRB/vjr
?649F
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 7e1.
