As discussed at the September <br />13 informal conference regarding PR-03,the Division must respond to comments <br />received following the informal conference and then, issue a proposed decision <br />on the PR within 60 days of the conference. This letter includes responses to the <br />comments in your letter. Portions of your comments are repeated below in italics <br />and the Division's responses follo4b. <br />It is premature to be approving Bowie's permit revisions... There are many <br />unresolved issues.,.How can the public be expected to comment? <br />The DMG is not proposing to approve PR-03 and will not do so unless and until <br />all technical adequacy issues have been resolved and the application complies <br />with applicable regulations. We will continue to make every effort to keep <br />commentors abreast of the status and processes involved with PR-03. We are <br />forwarding this letter as part of that effort since some technical adequacy issues <br />are still being addressed by BRL. <br />As mentioned above, the coal regulations provide BRL a right to a proposed <br />decision on PR-03 within 60 days of the informal conference, assuming that <br />technical adequacy issues have been resolved. This means that the Division <br />should issue a proposed decision on PR-03 by November 12, 1999, unless BRL <br />waives their right to that due date. The Division will continue to notify you <br />whenever technical adequacy questions or answers become available, and will <br />continue to respond to your comments throughout this permitting process. <br />STATE OF COLORP~DO <br />
