As discussed at the September
13 informal conference regarding PR-03,the Division must respond to comments
received following the informal conference and then, issue a proposed decision
on the PR within 60 days of the conference. This letter includes responses to the
comments in your letter. Portions of your comments are repeated below in italics
and the Division's responses follo4b.
It is premature to be approving Bowie's permit revisions... There are many
unresolved issues.,.How can the public be expected to comment?
The DMG is not proposing to approve PR-03 and will not do so unless and until
all technical adequacy issues have been resolved and the application complies
with applicable regulations. We will continue to make every effort to keep
commentors abreast of the status and processes involved with PR-03. We are
forwarding this letter as part of that effort since some technical adequacy issues
are still being addressed by BRL.
As mentioned above, the coal regulations provide BRL a right to a proposed
decision on PR-03 within 60 days of the informal conference, assuming that
technical adequacy issues have been resolved. This means that the Division
should issue a proposed decision on PR-03 by November 12, 1999, unless BRL
waives their right to that due date. The Division will continue to notify you
whenever technical adequacy questions or answers become available, and will
continue to respond to your comments throughout this permitting process.
STATE OF COLORP~DO
