EXHIBIT S <br />PERMANENT MAN MADE STRUCTURES <br />No permanent man made structures are located within 200 feet of the mining area. <br />However, the Harland Irrigation Ditch is located more than 75 feet from the proposed <br />process, stockpile, and staging area. This area has had various types of industrial activity <br />occurring near the ditch for many years. The activities have not affected the structural <br />integrity of the ditch. Additionally, the haul route has used an existing ditch crossing <br />constantly since 1980 without any adverse affects to the ditch. <br />A copy of a letter from the applicant to the Hartland Ditch Company can be found on the <br />following page.
