Cottony <br />Division Director <br />Natural Resource Trustee <br />On January 14, 2004 the Division of Minerals and Geology (Division) approved the Amendment application <br />submitted to the Division on August 5, 2003, addressing the following: <br />Addition of 67 Acres to the permit area and changes to the Reclamation Plan <br />Upon approval of AM-01, the terms of the amendment approved by the Division were incorporated into Permit M- <br />1989-120. In a letter dated January 15, 2004, from the Division, Aggregate Industries was notified of the approval <br />of AM-01 and that the estimated liability amount for the amended permit totals $754,732, or $634,732.00 more than <br />the current amount of $120,000.00. The Division has not yet received the additional bond. <br />Rule 4.2.1 (2) of the Construction Materials Rules and Regulations states that 1n the event that the Office or Boazd <br />determines that the Financial Warranty (currently held for a permit) is insufficient to perform reclamation, the <br />Permittee shall have up to sixty (60) days to post additional Financial Warranty from the date of written notice from <br />the Office or Boazd of such insufficiency. Therefore the additional bond amount of $632,732.00 was due on Mazch <br />15, 2004. <br />If you have not already done so, please submit an additional bond in the amount of $634,732.00 for the Platte Valley <br />Operation. The deadline for the above corzective action is set for May 5, 2004.
