Chiappone <br />Minerals Division Program Assistant II <br />Re: Morgan County's Vancil Pit, Permit No. M-1979-210, Application Package to <br />convert Construction Materials 110 Reclamation Permit a 112. <br />Deaz Ms. Chiappone: <br />This letter is in response to you May 14, 2001 letter to Joe Intermill concerning <br />Permanent Man-Made Structures within 200 feet of our proposed mining operation. <br />This letter is to certify that Morgan County will not conduct any mining within 200 feet <br />of the landowner's fence until an agreement has been reached between Morgan County <br />and the landowner stating that Morgan County is responsible for any damages that should <br />occur to the fence that are a direct result of Morgan County's mining operation. It is <br />further certified that no mining will be done within 200 feet of the High-line Towers until <br />an agreement has been reached with Tri-State Generation and Transmission Association <br />that Morgan County will be responsible for any damages done to the towers as a direct <br />result of Morgan County's mining operation. <br />Thank you for you cooperation in this matter. <br />Ver Truly Yours, <br />Joe B.
