Loc hhead <br />Execmive Director <br />Michael B. Long <br />Division Dneclor <br />I have completed a preliminary adequacy review of Bear Coal Company's application for TR-25. I have <br />the following questions and comments regarding the application. <br />1. The Division is concerned with the proposed location of the pond, since it is at the toe of an <br />active slide. Bear Coal Company should consider constmcting the pond in a more stable area, <br />and if such an area would not be feasible, document that this is the case. <br />2. Has Bear Coal Company applied for a new outfall under their CDPS permit, or will an existing <br />outfall location be modified? The Division will need a copy of approval for the discharge from <br />the CDPHE before this revision can be approved. <br />3. Does Bear Coal Company intend to treat the mine water prior to discharge? If so, please provide <br />information regarding the treatment process. <br />4. Please provide additional information as to how the water from the slide area will be directed to <br />the pond. If stmctures, such as pipes or channels are to be installed, design information must be <br />included in the revision application. <br />5. The design information for the pond does not appear to consider any stormwater inflow. If the <br />pond is not intended to treat any surface mnoff, a diversion ditch will need to be designed and <br />constmcted, and stormwater considered for the pond surface and area between the diversion and <br />pond only. <br />6. Bear Coal Company needs to indicate a maximum sediment storage level for the pond, to ensure <br />that sediment levels remain below the elevation of the primary discharge pipe. <br />The certification statement indicates the pond design was developed in 1977.
