Lochhead <br />Executive Director <br />Michael B Long <br />Divmon Diredoi <br />The Division completed an initial technical review of your submittal to utilize process water <br />from the Nixon Power Plant to wash the excavated sand and gravel at the site. <br />The Division is concerned that the power plant water may adversely affect the prevailing <br />hydrologic balance of the affected land and the surrounding azea as to the quality of water in <br />surface and groundwater systems both during and afrer the mining operation and during <br />reclamation. Pursuant to Rule 3, disturbances to the hydrology and water quality must be <br />minimized. <br />The concern, since it is under thejurisdiction ofthe Division, is the possible contamination or <br />degradation of groundwater. Your submittal does not adequately address the issue. Rule 3.1.7 <br />outlines specific requirements for groundwater standards and conditions. The Division will <br />require detailed information regarding depth to groundwater, whether [he groundwater is <br />classified or unclassified, what the existing and reasonably potential future uses are for the <br />groundwater, how you intend to protect those existing and future uses, what permit conditions <br />you propose to establish for the site, Where you intend to install points of compliance and how <br />you intend to gather, or establish, base line data for the groundwater. <br />The Division notified the CDPHE of your request to use the power plant's process water so, if <br />they have any concerns, they may ask for additional information. <br />The decision due date for this T.R. is Jvly 23, 1997. If you cannot fully respond to this adequacy <br />letter by the due date you should either ask for an extension or waive your right to a 30 day <br />decision. <br />If you have any questions, please give me a call. <br />
