However, I have <br />some better mapping that clearly shows the new road disturbance will be within 100-feet of the edge of the creek. <br />The drill site probably will not be within 100 feet of the creek. The creek is 30+ feet below the proposed <br />disturbance so there is no riparian vegetation in the area of proposed disturbance. The Division, of course, will need the signed hard copy before MR-75 can be approved. I <br />do have one question concerning MR-75, however. <br />For MR-75, I measured the distance on Map 9 from Hubbard Creek to the closest projected disturbance <br />(including the proposed road). It was just over 100 feet. Please confirm that the MR-75 proposed <br />disturbance is greater than 100 feet from Hubbard Creek. This is important since Rule 4.05.18 requires <br />a findings from the Division if there is disturbed land within 100 feet of a perennial stream. Thanks. <br />3/1/2007 <br />
