Please note
that they have requested the Office of Surface Mining to make a preliminary
determination of potential impacts to endangered species by associated
depletion of the Colorado River. The OSM may then request formal consultation
from the Fish and Wildlife Service.
The Division will withhold issuance of a proposed decision until after this
issue, as well as those listed in our adequacy letter of June 4, 1991 are
resolved. Since a proposed decision is due on July 15, 1991 we urge NCIG to
waive in writing the right to a decision within the time frames described in
Rule 2.08.4(5)(b)(ii), so that the review period may be extended.
Please call if you wish to discuss this issue further.
Sincerely,
~~~~~
William B.
