Dear Mr. Rosar:
We have reviewed the October 10th reply letter from Mr. Martin Jones. After
reviewing this letter, we believe our concerns are closer to being resolved
except as listed below. Please respond to the following (which utilizes the
original numbering sequence) as soon prior to October 23rd as possible.

1. How many acres is encompassed by the well area and associated pipeline =~
(specifying width and length) to the mine area? It is necessary to
submit additional application fees to reflect this acreage. o ,.w;
Also, please describe the proposed reclamation for the well, well area, -
and pipeline; and the associated legal description to the nearest
quarter quarter section.

2. Enclosed is a new Financial Warranty - Corporate Surety form. Please

3. Enclosed is a Performance Warranty that should be immediately executed
and returned to this office.

4A. Please justify the additional $5,000.00 amount. The previously posted
$5,000.00 amount for this area was the maximum allowed by law due to
the type of permit (i.e.: Limited Impact (110) Permit). This permit is
a Regular (112) Permit with no such financial Warranty restrictions.
( Therefore, we are uncertain if $5,000.00 is justifiable or not.
