AGRA Project E94-7033 <br />Water Supply Branch <br />Colorado Division of Water Resources <br />1313 Sherman Street, Room 818 <br />Denver, CO 80203 <br />RE: December 2, 1994 Meeting Concerning Water Issues for Southdown, Inc.'s Dowe <br />Flats Limestone Mine, Near Lyons, Colorado <br />Dear Dick: <br />I thought it would be useful to summarize discussions at our meeting. <br />We all agreed that the Division of Minerals and Geology (Colorado Mined Land Reclamation <br />Board) could approve the Dowe Flats permit amendment on the December 9, 1994 decision <br />date with certain permit conditions relevant to the Division of Water Resources (DWR). Those <br />conditions are that any required permits be obtained prior to exposing ground water and that <br />a financial warranty be posted to cover backfilling of the pits to an elevation necessary to <br />cover the ground water table. The approach of using permit conditions allows certain mine <br />construction activity to go forward while the operator meets the requirements of the Division <br />of Water Resources, prior to exposing ground water, creating wetlands or dewatering the <br />mine pits. <br />More specific items of discussion follow: <br />• The construction of a 20 acre wetland in the northeastern part of the mine (in about <br />year 20 of the mine plan- can be addressed at that time, prior to exposing ground <br />water in the wetland area. The CMLRB permit should have a condition requiring that <br />Southdown secure all appropriate permits from the Division of Water Resources and <br />post a financial warranty for backfilling the pit to and elevation above the ground water <br />table. <br />Prior to disturbing any ground water the operator will secure all appropriate permits <br />from the DWR and post a financial warranty for backfilling the pit to an elevation <br />above the ground water table. <br />The DWR will require a dewatering permit which can be done using a "well field <br />concept". The applicant can obtain one permit using the centroid of the mine as the <br />permit location and accommodate multiple, moving dewatering pumps.
