Wright <br />Post Office Box 535 <br />Somerset, Colorado 81434 <br />Dear Mr. Wright: <br />We are responding to your request for a Department of the <br />Army permit for the extension of an existing nine-foot diameter <br />Elk Creek culvert and relocation of a portion of the Elk Creek <br />channel. The project is located at Elk Creek within Section 8, <br />Township 13 South, Range 90 West, Gunnison County, Colorado. <br />The Chief of Engineers has issued nationwide general permit <br />number 21 which authorizes the discharge of dredged or fill <br />material in waters of the United States for surface mining <br />activities. This verification authorizes the installation of an <br />additional 1,100 feet of culvert and the relocation of 1,100 feet <br />of Elk Creek in accordance with your application dated May 13, <br />1.999. We have determined that your project will not affect <br />threatened or endangered species projected by the Endangered <br />Species Act. Your project can be constructed under this <br />authority provided the work meets the conditions listed on the <br />enclosed information sheets and the following special conditions: <br />1. The permittee shall minimize disturbance to Elk Creek and <br />adjacent wetland to the maximum extent practicable as stated in <br />Ms. Kathleen Welt's letter dated July 1, 1999. <br />2. The permittee shall utilize retaining walls at the project <br />site whenever possible to control fill entering into waters of <br />the U.S. <br />3. The permittee shall design and implement a wetland fringe <br />into the reconstructed channel section of Elk Creek. <br />4. The permittee shall provide the Corps of Engineers with a <br />compensatory mitigation plan in accordance with the Corps Habitat <br />Mitigation and Monitoring Guidelines for all other impacts to <br />waters of the U.S. for written concurrence prior to disturbance <br />of waters of the U.S. at the project site. <br />You must send a signed letter of certification to the Corps <br />of Engineers within 30 days after completion of the work (see <br />general condition number 14). A copy of the certification <br />statement is included for your use. <br />
