To date, there has been no
movement at all by Western Gravel to correct this very unsightly
situation.
C. The Water Users' property has previously been
described as range land, but it is, along with the contiguous
property, level land and with irrigation water is productive farm
land. We understand that a number of years ago, the Water Users
condemned the property because irrigation water was washing the
hillside into the canal. Since there has not been any irrigation
on that property for approximately ten years, it is quite ludicrous
for Western Gravel to claim that they are removing the gravel in
order to prevent future land slides. There surely are less
destructive alternatives other than the creation of a gravel pit
being operated by a company which has absolutely no respect for
property values in the neighborhood or their neighbors' wishes.
D. Since the gravel pit began operating, Ms. Galbreth's
property has been broken into at least twice and even though she
has "no trespassing" signs on all four boundary fences, large
numbers of hunters ignore those signs and continue to trespass on
her property. She believes that until the gravel pit opened, the
class of people who would break into property and disregard no
trespassing signs didn't even know that her property was there.
E. Because of the fact that Western Gravel refuses to
clean up the trash dump they created along Ms. Galbreth's property
line, she has gone to considerable physical and monetary expense to
plant trees to try to shield the eye sore from her side of the
fence.
F. In addition to their trash and junked machinery,
Western Gravel has deposited numerous 55 gallon drums along Ms.
Galbreth's fence line, the contents of which are unknown. Our
client suspects that, given Western Gravel's unconcern about the
environment, they are also depositing toxic waste on the property.
G. Western Gravel's trucks have significantly damaged
the two lane country roads, both dirt and asphalt, leading to the
property because they are consistently heavily over-loaded. They
have made absolutely no effort to repair the damage they have
created.
