Woods Seepage Ditch <br />Dear Sirs: <br />This letter responds to your Statement dated March 25, 1995 requesting that Western <br />Mobile, Inc. pay you $423,360 for pumping of water that you claim to own. It al:~o responds <br />to your offer to sell Western Mobile the I.C. Woods Seepage Ditch water right. <br />Following receipt of your March 25 Statement, Western Mobile incurred substantial legal <br />and engineering costs investigating your claim for money from Western Mobiile, and your <br />claim regarding the value of the I.C. Woods Seepage Ditch water right. Westem Mobile's <br />lawyers have reviewed the decree for the I.C. Woods Seepage Ditch +and related <br />documents and have reviewed the applicable law. Western Mobile's engineers have <br />investigated the facts, including participation in the April 25, 1995 meeting in Use field with <br />John F. Glass, Sr. and his real estate agents, Dennis Gallegos and Lloyd Wilson, to try to <br />find the structures which you describe as the "ICWOODS Water Rights :system". In <br />addition, our engineers have reviewed the decree and have investigated the claims made <br />in your prospectus dated June 30, 1990 titled "I.C. Woods Water Right, LaPorte/Fort <br />Collins, Colorado". <br />The following is a summary of our conclusions: <br />1. Westem Mobile is not interested in purchasing the I.C. Woods Seepage Ditch water <br />right or the "ICWOODS Water Rights System" (sometimes referred to as the "I.C. <br />Woods Drain"). <br />2. Western Mobile has not taken any water that you own and does not owe you any <br />money for water it has pumped from its gravel pits. <br />-An Equal Opportunity Employer - <br />
