<br />[Insert as new page 4-100(a) through 4-100(c)] <br />4.5.2.2 Diamond-A Parcel. <br />Description. A portion of the loadout facility is <br />located on what is commonly referred to as the Diamond-A <br />Ranch. Such portion of the loadout facility is hereinafter <br />referred to as the ^Diamond-A Parcel' and is more particularly <br />described as: <br />All portions of the Permit Area located north <br />and east of the center of the Roaring Fork <br />River in Township 7 South, Range 88 West, 6th <br />Prime Meridian, Section 20, Lots 10, 11, 12, <br />15 and 16, and Section 29, Lots 2, 3 and 4. <br />Land Use Classification. Notwithstanding anything to <br />the contrary contained in this Permit, the Diamond-A Parcel is <br />approved for post-mining land uses falling within the <br />°residential° and °industrial° land use classifications, as <br />such terms are defined by paragraphs 1.04(71)(e) and (f) of <br />CMLRD Rule 1, so that the Diamond-A Parcel may be physically <br />incorporated into any future development of the Diamond-A <br />Ranch, including but not limited to the development of a <br />residential community with a golf course and related retail <br />establishments. Such change in land use classification shall <br />become effective on the date on which the Division receives <br />evidence that the Garfield County land use authorities have <br />approved a planned unit development plan or other zoning <br />changes that allow for development of the Diamond-A Parcel. <br />Reclamation. Phase I reclamation success standards <br />for backfilling and grading described in the original <br />reclamation plan for the Diamond-A Parcel were achieved in <br />1988. Accordingly, the permittee was released from further <br />liability in that regard pursuant to the Division's approval <br />of Technical Revision Number 07 in March, 1988. As documented <br />in pages 4-99(b) through 4-99(e) above, revegetation and <br />stabilization success standards have now been achieved for the <br />Diamond-A Parcel. The only reclamation obligation that <br />remains to be completed with respect to the Diamond-A Parcel <br />is the removal of the two concrete footers located on the east <br />bank of the Roaring Fork River. Accordingly, upon the removal <br />of the two concrete footers, all reclamation obligations with <br />respect to the Diamond-A Parcel will have been satisfied. <br />Performance Standards. The Division acknowledges <br />that the development of the Diamond-A Ranch will involve <br />substantial new disturbances of the Diamond-A Parcel and that <br />4-100(a) <br />
